Monterey Minivan Campers
Rental Waiver, Assumption of Risk, and Release of Liability
IMPORTANT: PLEASE READ CAREFULLY BEFORE SIGNING.
This Rental Waiver, Assumption of Risk, and Release of Liability ("Agreement") is entered into by the renter ("Renter") in consideration for renting a vehicle from Monterey Minivan Campers ("Company"). By signing this Agreement, Renter acknowledges that they have read, understood, and voluntarily agree to the following:
1. Assumption of Risk
Renter understands that operating or occupying a motor vehicle involves inherent risks, including but not limited to accidents, collisions, mechanical failures, road hazards, weather conditions, wildlife, negligence of other drivers, fire, theft, property damage, serious bodily injury, permanent disability, and death. Renter voluntarily assumes all such risks.
2. Vehicle Condition
Renter agrees to inspect the vehicle before use and to operate it safely and in accordance with all applicable laws. Renter will immediately discontinue use if the vehicle appears unsafe.
3. Release of Liability
To the fullest extent permitted by law, Renter, on behalf of themselves, their passengers, heirs, estate, representatives, and assigns, releases and forever discharges Monterey Minivan Campers and its owners, employees, agents, and affiliates from any and all claims, demands, causes of action, liabilities, damages, losses, costs, or expenses arising out of or related to the rental, use, or occupancy of the vehicle, including claims involving personal injury, illness, property damage, permanent disability, or death, whether caused by negligence or otherwise, except where prohibited by law or resulting from gross negligence or willful misconduct.
4. Indemnification
Renter agrees to defend, indemnify, and hold harmless the Company from any claims, damages, attorney's fees, or expenses arising from Renter's use or misuse of the vehicle, including claims brought by passengers or third parties.
5. Passenger Responsibility
Renter accepts responsibility for ensuring all passengers comply with applicable laws, including seat belt requirements, and acknowledges this release extends to claims arising from passenger injuries where legally enforceable.
6. Insurance
Renter acknowledges they are responsible for maintaining any insurance required under the rental agreement or applicable law.
7. Governing Law
This Agreement shall be governed by the laws of the State of California. If any provision is found unenforceable, the remaining provisions shall remain in effect.
8. Electronic Signature
Renter agrees that an electronic signature has the same legal effect as an original handwritten signature.
Acknowledgment
I certify that I am at least 21 years of age, possess a valid driver's license, have read this Agreement in its entirety, understand its contents, and voluntarily agree to be legally bound by its terms.
